Terms of Use
1. The service
DroptionSA is a South African car-culture platform that may include Digi-Cert verification, Garage and certificates, Feed / Build Pages, Marketplace, Crews, Battles, Events and tickets, Gifts, Coins, Safe, Plate Scanner, search, notifications, and related features.
Features may be added, changed, limited by region, offered in sandbox / test mode, or discontinued. We do not guarantee that every feature will always be available.
2. Eligibility & accounts
- You must be at least 18 years old and legally able to enter a binding agreement.
- You must provide accurate registration information and keep it up to date.
- You are responsible for activity under your account and for protecting your login method (Google, Apple, email/password, or phone).
- One person should not create accounts to evade bans, manipulate Digi-Cert, votes, gifts, or Marketplace outcomes.
- If you use the app on behalf of a business, you confirm you have authority to bind that business.
3. Acceptable use
You agree not to:
- Break any applicable law (including fraud, stolen goods, identity theft, or prohibited content).
- Harass, threaten, defame, discriminate against, or exploit other users.
- Upload sexual content involving minors, or any sexual content that violates law or these Terms.
- Submit forged, stolen, or misleading Digi-Cert / ownership documents or media.
- Impersonate another person, builder, or Digi-Cert identity.
- Spam, scrape, reverse engineer (except where law allows), probe, overload, or interfere with the service.
- Use bots or automation to manipulate respects, votes, gifts, RSVPs, or rankings.
- Use Marketplace or chat to scam, phish, or solicit unlawful payments.
- Infringe intellectual property, privacy, or publicity rights.
- Bypass security, rate limits, or access controls.
4. Digi-Cert, Garage & certificates
- Digi-Cert is a DroptionSA verification and identity feature for builds. It is not a government registration certificate and does not replace NaTIS / licensing requirements.
- You must only submit documents and media you are legally entitled to use, for vehicles you own or are authorized to verify / transfer.
- Moderators may approve, reject, request more information, or reverse Digi-Cert status if fraud or error is discovered.
- Build Levels, DNA, achievements, leaderboards, and certificates are platform features that may change. Certificates may be issued, updated, emailed, or revoked according to product rules.
- Ownership transfer of Digi-Cert (including after Marketplace sales) must follow supported in-app flows. Attempting to sell or claim Digi-Cert outside those rules may result in rejection or account action.
- Plate Scanner and Digi lookups are provided to help discover Digi-Cert builds and are subject to rate limits and accuracy limits.
5. User content licence
You retain ownership of content you create (photos, captions, comments, voice notes, listings, chat messages, and similar). You grant DroptionSA a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for display), communicate, and distribute that content as needed to operate and promote the service (including Feed, Build Pages, certificates, Marketplace, Crews, Events, and moderation).
You confirm you have the rights to upload the content and that it does not violate these Terms. We may remove content that appears to violate the law or these Terms.
6. Marketplace
- Marketplace helps buyers and sellers list Digi-Cert Builds or parts and communicate.
- Unless a protected in-app checkout feature is clearly enabled and completed for a transaction, payment and handover may occur off-platform between users. In that case, DroptionSA is not the buyer or seller and is not a party to the private sale contract.
- You are solely responsible for inspecting goods, agreeing price and handover terms, complying with South African vehicle / consumer laws, and assessing counterparty risk.
- Listings must be accurate. Do not list stolen goods or misrepresent Digi-Cert status.
- When a listing is marked sold, related inquiry chat may become read-only. Digi-Cert transfer may require additional ownership proof and moderator review.
- “Protect” / escrow-style purchase flows, if shown, may be incomplete or not live for card payments. Do not assume funds are held by DroptionSA unless the app clearly confirms a live protected payment.
7. Crews, Battles & Events
- Crew founders and admins are responsible for lawful crew activity and member management within product tools.
- Battles, votes, and related DNA effects follow in-app rules and may be adjusted to prevent abuse.
- Event hosts must provide accurate event information. Ticket purchases (when enabled) are subject to the ticket terms shown at checkout and any sandbox limitations during testing.
- Ticket emails / QR codes are for access control and record-keeping; misuse may void tickets.
8. Coins, gifts & Safe
- Coins, gifts, DNA effects, and Safe balances are digital features inside DroptionSA.
- Unless we expressly offer a live cash withdrawal product and you complete any required identity / payout checks, virtual balances have no cash value outside the app and are not redeemable for money.
- Sandbox or development economies may be reset, capped, or disabled.
- We may reverse suspicious gifts, coin grants, or Safe movements linked to fraud, chargebacks, or Terms violations.
- Purchased coins (when live paid packs exist) are generally non-refundable except where required by law.
9. Fees
Certain features may involve fees (for example Digi-Cert verification / renewal / transfer fees, Marketplace-related fees, ticket prices, or coin packs) when those products are live. Amounts and payment methods will be shown in the app before you confirm. Unpaid or failed payments may delay or cancel the related feature.
10. DroptionSA intellectual property
The DroptionSA name, marks, app design, software, certificates templates, and other platform IP are owned by us or our licensors. You may not copy, brand-jack, or exploit them except as allowed through normal use of the app.
11. Moderation, reporting & enforcement
- We may review content and Digi-Cert submissions, including with human moderators.
- You can report content, listings, messages, or profiles through in-app tools where available.
- False or abusive reports may themselves lead to enforcement action.
- We may remove content, limit features, reverse Digi-Cert outcomes, or suspend accounts where we reasonably believe these Terms or law were violated.
12. Suspension, termination & deletion
We may suspend or terminate access immediately for Terms violations, fraud risk, legal risk, or to protect the community. You may stop using DroptionSA at any time. To request account deletion, email support@droptionsa.com from your account email. Deletion is subject to our Privacy Policy retention needs (for example fraud prevention or legal records).
13. Disclaimers
DroptionSA is provided on an “as is” and “as available” basis. To the maximum extent permitted by South African law, we disclaim warranties of uninterrupted service, perfect accuracy of Digi-Cert outcomes, Plate Scanner results, leaderboards, or that any Marketplace counterparty will complete a deal honestly or safely.
Meet-ups and off-platform payments are at your own risk. Take sensible safety precautions.
14. Limitation of liability
To the maximum extent permitted by applicable law (including the Consumer Protection Act where it cannot be excluded), DroptionSA and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the app or from user-to-user transactions.
Where liability cannot be excluded, our aggregate liability related to the service is limited to the greater of (a) ZAR 500 or (b) the amounts you paid to DroptionSA for the specific paid feature giving rise to the claim in the 3 months before the claim (excluding amounts paid to other users off-platform).
15. Indemnity
You agree to indemnify and hold DroptionSA harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your content, your Marketplace conduct, your Digi-Cert submissions, or your breach of these Terms or applicable law.
16. Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa. Courts of South Africa have jurisdiction, without limiting any non-waivable consumer rights you may have.
17. Changes to these Terms
We may update these Terms as the product evolves. We will change the “Last updated” date and may provide in-app or email notice for material changes. Continued use after changes means you accept the updated Terms.
